TidyDial Terms of Use

These Terms of Use ("Terms") govern your access to and use of the TidyDial service ("Service"), provided by Pixel Main, Inc., a South Dakota corporation ("Company").

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the Service.

1. Description of Service

TidyDial provides users with the ability to rent phone numbers for use within third-party Customer Relationship Management (CRM) platforms, enabling users to make calls and send SMS messages through their CRM easily. The Service allows users to manage their rented phone numbers and associated communication activities.

2. User Responsibilities

• You are solely responsible for your use of the Service.

• You agree to comply with all applicable federal laws and regulations, including but not limited to the Telephone Consumer Protection Act (TCPA), the CAN-SPAM Act, the Truth in Caller ID Act, and any rules or regulations issued by the Federal Communications Commission (FCC) governing telecommunications and messaging services.

• You agree to comply with all applicable local, state, and federal laws and regulations while using the Service, including but not limited to any rules or regulations issued by the Federal Communications Commission (FCC).

• You agree not to use the Service for any illegal or unauthorized purpose.

3. Rental of Phone Numbers

The rental of phone numbers through TidyDial is subject to additional terms and conditions outlined in the rental agreement.

You agree to abide by the terms of the rental agreement for each phone number rented through the Service.

4. Payment and Account Suspension

Users of the Service are required to pay a monthly subscription fee for access to the Service. Failure to pay the subscription fee may result in suspension, deactivation, or deletion of the user's account and access to the Service. The Company reserves the right to take such actions in its sole discretion.

The Company shall not be liable for any damages, losses, or inconvenience resulting from the suspension, deactivation, or deletion of a user's account due to non-payment.

5. Limitation of Liability

The Company shall not be liable for any direct, indirect, incidental, special, consequential, or exemplary damages, including but not limited to, damages for loss of profits, goodwill, use, data, or other intangible losses resulting from the use or inability to use the Service.

6. Termination

The Company reserves the right to suspend or terminate your access to the Service at any time, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms.

7. Changes to Terms

The Company reserves the right to change these Terms of Use at any time with or without notice. Your continued use of the Service after any changes to these Terms constitutes acceptance of those changes.

8. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of South Dakota, without regard to its conflict of law provisions.
